County announces victory in Browns Canyon illegal dumping case

Supervisor Barger is pleased to report that on June 1, 2018, Judge Pfahler issued an order preluding all Class 6 or higher trucks from Browns Canyon. Judge Pfahler also reaffirmed that his December 2015 order precluding this illegal dump remains in full force and effect.
Our attorneys have submitted a formal injunction to the defendants’ attorney and that formal order will be submitted to Judge Pfahler for his review and execution on Tuesday, June 12. That is the first date the county can submit such under the court rules.
Once the preliminary injunction is signed by Judge Pfahler, it must be personally served on all defendants. The county will expeditiously accomplish service.
The county will collaborate with our sister jurisdictions to actively monitor and enforce compliance with Judge Pfahler’s orders.
The defendants are required to immediately conform their actions in Browns Canyon with the rule of law including Judge Pfahler’s December 23, 2015 and June 1, 2018 orders.
